General Terms and Conditions of Sale

Scope

These General Terms and Conditions govern sales transactions carried out through the e-commerce platform and digital payment channel of www.factoryoficina.com between FactoryOficina S.L. and its customers.

Where the purchaser qualifies legally as a consumer or user, the mandatory provisions of the applicable consumer protection legislation shall also apply. Where the purchase is made in the course of a business or professional activity, these terms and the applicable commercial and civil legislation shall apply.

Contracting Parties

The sales contract is concluded with FactoryOficina S.L., Tax Identification Number (NIF) B85772614, registered office at Calle Mediterráneo, 8 - PTL 6. PISO 2 D, Alcorcón, 28922, Madrid, Spain, registered with the Madrid Commercial Registry, Volume 27022, Folio 82, Section 8, Page M 486880, Entry 4 (23.04.18).

Contract Formation

By clicking the “complete purchase” button, the customer makes a binding declaration accepting the order and undertaking to pay the corresponding amount. The customer will subsequently receive an acknowledgement confirming receipt and processing of the order.

Contract Language

The contract may be concluded in Spanish.

Contract Records

Contracts concluded through the online store are kept on record. Customers may access their orders through their customer account or request information by emailing info@factoryoficina.com.

Price

Prices are stated in euros. The online store displays the price before VAT together with the corresponding final price including VAT, calculated using the legally applicable tax rate.

Before confirming the order, the customer will be informed of the total purchase amount, including applicable taxes and, where relevant, any additional transport, delivery or associated service charges.

Unless expressly stated otherwise, product prices do not include any additional shipping charges applicable to destinations outside mainland Spain.

Delivery

Delivery times depend on the type of product purchased:

• Refurbished products: the estimated delivery time is 3 to 7 business days from confirmation of payment.
• New products: the delivery time will be stated on the relevant product page and will correspond to the period indicated in its description.

In all cases, delivery times will begin to run only after full payment of the order has been received.

Shipping Costs

Shipping is free within mainland Spain. For all other destinations (Portugal, Andorra, Ceuta, Melilla, Balearic Islands and Canary Islands), transport costs will be calculated individually according to the order and communicated to the customer before the purchase is confirmed.

Payment Methods

The following payment methods are available: bank transfer, credit/debit card, PayPal and instalment payments. Where bank transfer is selected, the relevant bank account details will be provided by email.

Transfer of Risk and Transport Damage

The risk of loss of or damage to the goods passes to the consumer when the consumer or a third party designated by the consumer, other than the carrier, acquires physical possession of the goods.

We recommend that customers inspect the goods and their packaging at the time of delivery. Where visible damage, knocks, breakages or defects are detected, it is advisable to record the incident on the delivery note before signing it.

To facilitate and speed up any claim with the carrier, we recommend notifying FactoryOficina of the incident, together with photographs of the product and packaging, preferably within 24 hours of delivery, by email to info@factoryoficina.com.

This notification procedure helps us deal with transport incidents more quickly and does not limit any statutory rights available to consumers.

Right of Withdrawal and Returns

Where the statutory right of withdrawal applies, FactoryOficina gives consumers a period of 15 calendar days from receipt of the order to notify us of their decision to return the products, without having to provide a reason.

The direct costs of returning the goods shall be borne by the customer, except where the return results from an error by FactoryOficina, a defective product or any other circumstance in which FactoryOficina is legally required to bear those costs.

New products made to order or customised. Products manufactured or prepared according to specifications selected by the customer —including dimensions, colours, finishes, upholstery, configurations or other individualised characteristics— are excluded from the statutory right of withdrawal in accordance with applicable legislation.

Nevertheless, FactoryOficina voluntarily allows these orders to be cancelled without charge during the 2 business days following confirmation of the order. Once this period has elapsed, any cancellation or return voluntarily accepted by FactoryOficina may be subject to a 30% reduction in the value of the product, together with the corresponding transport costs, as these items are manufactured or prepared specifically according to the customer's choices.

Condition of returned goods. Products subject to the right of withdrawal must be returned complete, suitably protected and with all accessories and original components. The original packaging should be used whenever possible. The consumer shall only be liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Refund. Where the statutory right of withdrawal applies, FactoryOficina will make the refund without undue delay and, in any event, within 14 calendar days from the date on which it is informed of the consumer's decision to withdraw. FactoryOficina may withhold the refund until the goods have been received or until the consumer provides evidence that they have been returned, whichever occurs first.

The refund will be made using the same payment method used for the original transaction, unless expressly agreed otherwise, without the consumer incurring any costs as a result of the refund.

Warranties

Products sold by FactoryOficina are covered by the statutory conformity guarantee applicable under Spanish Royal Legislative Decree 1/2007 and all other applicable legislation.

• Factory New — New product: 3-year warranty from delivery.
• Factory Selection — Premium refurbished: 2-year warranty from delivery.
• Factory Rebuild — Refurbished: 1-year warranty from delivery.

For second-hand or refurbished products, the periods indicated form part of the terms of sale agreed with the customer and will in all cases respect the statutory minimum period.

The warranty covers lack of conformity under the terms established by applicable legislation, without prejudice to any additional commercial warranty that FactoryOficina may expressly offer for specific products.

Retention of Title

Ownership of the products will be transferred only once the full amount of the order has been paid.
